In practice, entrepreneurs receive less protection than consumers and need legal advice more quickly.

As an entrepreneur, you can rent two types of business premises: office/storage space or catering/retail space – they do not fall under the same tenancy law rules! Therefore, it is very important that a real estate lawyer checks your lease contract before you sign anything.

Termination of rental agreement

When it comes to termination of a lease, different protection rules apply for different types of premises.

Eviction of the rented property

In addition, a landlord can request eviction through the courts if he believes that the termination of the rental agreement must take place sooner and the applicable notice period cannot be waited (e.g. in case of rent arrears or nuisance). In that case, you will receive a summons for a summary proceedings hearing, a procedure in which the landlord requests the court to terminate the rental agreement concluded with you and to oblige you to vacate the rented property. If you receive such a summons, it is very important to immediately call in a lawyer to prevent the landlord from vacating the property.
